Terms of Service

Effective Date: October 1, 2026. These Terms of Service (“Terms”) govern your access to and use of the Makin' Weight website, intake tools, and related telehealth services (the “Services”), operated in connection with Wellness MD Group. By creating an account, completing an intake questionnaire, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who Can Use These Services

The Services are available only to individuals who are physically located in the State of California at the time of intake, consultation, and any follow-up care; are current California residents; are at least 18 years of age; and can provide accurate, complete health and identity information when requested. Makin' Weight and its affiliated physicians are licensed to practice medicine in California only. We do not evaluate, treat, prescribe to, or ship medication to individuals located outside California, regardless of state of residency, temporary travel status, or billing address. If at any point we learn you do not meet these requirements, we may decline service, cancel a pending order, or terminate your account.

2. How the Service Works

Use of the Services generally involves: completing a health intake questionnaire, review of your intake by a California-licensed physician as part of a Good Faith Exam, and, if the physician determines treatment is clinically appropriate, issuance of a prescription that is filled by a licensed compounding pharmacy and shipped to your California address. Nothing about your intake, your payment method on file, or your use of the Services guarantees that a physician will prescribe any medication to you. Physicians exercise independent clinical judgment and may decline to prescribe, may request additional information, may recommend an alternative treatment, or may refer you elsewhere if they determine that treatment is not appropriate for you.

3. Compounded and Off-Label Medications

Some products offered through the Services are compounded medications prepared by U.S. PCAB-accredited pharmacies under an individual physician's prescription, rather than mass-manufactured, individually FDA-approved drug products. Some products may be prescribed for off-label uses. This means the FDA has not independently evaluated the specific compounded formulation, and in some cases has not approved the substance for the condition being treated. Your treating physician will discuss the relevant risks, alternatives, and evidence with you before prescribing, and you will have the opportunity to ask questions. You should not rely on marketing claims made anywhere on this site as a substitute for that individualized clinical discussion.

4. Payment, Billing, and Cancellation

Your payment method is collected and stored through a secure, PCI-compliant third-party payment system. Makin' Weight and Wellness MD Group do not receive or store your full card number on our own servers. You will not be charged until a California-licensed physician reviews and approves your treatment protocol. Once approved, your monthly price covers your prescribed medication, physician oversight, standard supplies associated with your treatment, and asynchronous messaging with your care team, unless otherwise stated at checkout. There is no separate membership or platform fee. You may cancel your subscription at any time before your next scheduled shipment or billing date by using your account settings or contacting support. Cancellation stops future charges and shipments; it does not entitle you to a refund of a shipment that has already been prescribed, compounded, or shipped, since compounded medications are prepared specifically for you and generally cannot be resold or returned. If you believe you were billed in error, contact us promptly and we will review the charge in good faith.

5. Your Account

You are responsible for maintaining accurate intake and contact information, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.

6. Intellectual Property

All content on this site — including text, graphics, logos, and the Makin' Weight and Wellness MD Group names and marks — is owned by us or our licensors and is protected by applicable intellectual property laws. You may view and use the site for your personal, non-commercial use in connection with obtaining care. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

7. Medical Disclaimer

The Services facilitate access to individualized medical care from independent, California-licensed physicians. General content on this website — including educational material about GLP-1 medications and peptide therapies — is provided for informational purposes and is not a substitute for personalized medical advice. Always follow the specific guidance given to you by your treating physician.

8. Limitation of Liability

To the fullest extent permitted by California law, Makin' Weight, Wellness MD Group, and their affiliates, officers, and employees will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services. This limitation does not apply to claims arising from professional negligence by a treating physician, which remain governed by applicable California medical malpractice law and are not limited or waived by these Terms. Nothing in these Terms limits liability where such limitation is prohibited by law.

9. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services that cannot be resolved informally will be subject to the exclusive jurisdiction of the state or federal courts located in California, except that either party may bring an individual claim in small claims court where appropriate. We encourage you to contact us first so we can try to resolve any concern directly.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. We will post the revised Terms with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
